Terms of Use

1. Acceptance and eligibility

By creating an account or using HatuaBid, you agree to these Terms and the Privacy Policy. You must be authorised to act for the company named in the account and to upload and process its tender information.

2. Account responsibility

You are responsible for accurate account information, protecting login credentials and all activity under your account. Multiple authorised users may work for the same company, but credentials must not be shared with unauthorised persons.

3. Tender documents and lawful use

You retain ownership of documents and content you upload. You grant HatuaBid and its service providers the limited right to host, process, analyse and reproduce that content only as needed to provide and secure the service. You must have the right and authority to upload every document.

4. AI-assisted outputs

HatuaBid assists with document review, evidence organisation and tender preparation. Outputs may be incomplete or incorrect and must be checked against the complete tender, all addenda and official clarifications. HatuaBid does not replace legal, procurement, financial or technical advice and does not guarantee eligibility, responsiveness or award.

5. Bidder responsibilities

• Verify every deadline, amount, form, page and clause reference against the official source documents.
• Obtain required clarifications and monitor later addenda or extensions.
• Confirm eligibility, prices, commercial choices, signatures, stamps and final approvals.
• Handle original bid securities, physical signing, packaging and delivery requirements personally where required.
• Complete a final human review before any online or physical submission.

6. Credits, fees and reruns

Credits and package prices are shown before purchase or assessment. A completed assessment run uses the applicable credit; a successful rerun may use another credit. A verified technical failure should not consume a credit. Final payment, refund, expiry and tax terms will be stated at checkout and should be legally reviewed before commercial launch.

7. Confidentiality and platform security

HatuaBid will use reasonable measures to protect company workspaces and confidential documents. Users must promptly report suspected unauthorised access and must not attempt to bypass security, interfere with the service or access another company’s information.

8. HatuaBid intellectual property

The HatuaBid name, platform, workflow, interface, reports, software and original content belong to HatuaBid Limited or its licensors. These Terms do not transfer ownership. Users may use generated reports internally for the tender and business purpose for which they were produced.

9. Availability, suspension and termination

Service interruptions may occur for maintenance, security or external-provider reasons. HatuaBid may restrict access where reasonably necessary to protect users, data or the platform. An account may be closed in accordance with the applicable retention and legal requirements.

10. Liability and governing law

To the extent permitted by law, HatuaBid is not responsible for losses caused by unverified AI output, omitted or late source documents, bidder error, external portals, tender cancellations or procurement decisions. Any final liability limitation, dispute process and commercial remedy must be settled by Kenyan counsel. These Terms are intended to be governed by the laws of Kenya.
